Terms of Service

1. Violation of this Agreement

In the case that the customer has violated this agreement, the account belonging to the customer will be immediately terminated upon the discretion of aqait.com and the refund policy/money back guarantee will automatically be void for the offending customer. In the case that sections of this agreement are disputable, aqait.com reserves the right to decide what is and what is not a violation of this agreement.

2. Delivery of Services

Domain Registration, Shared Hosting, and Reseller Hosting services are activated instantly, while other services are activated manually after payment. No service is provided without completing document verification, including your mobile number and national ID. Upon successful payment, an automated receipt will be sent from our billing system, which should be kept securely for future reference. All service-related information will be sent to the email address specified during account registration.

3. The following are not allowed:

1. Topsites
2. IRC Scripts/Bots
3. Proxy Scripts/Anonymizers
4. Pirated Software/Warez
5. Image Hosting Scripts (similar to Photobucket or Tinypic)
6. AutoSurf/PTC/PTS/PPC sites
7. IP Scanners
8. VPN Services
9. Bruteforce Programs/Scripts/Applications
10. Mail Bombers/Spam Scripts
11. Banner-Ad services (commercial banner ad rotation)
12. File Dump/Mirror Scripts (similar to Rapidshare)
13. Commercial Audio Streaming (more than one or two streams)
14. Escrow/Bank Debentures
15. High-Yield Interest Programs (HYIP) or Related Sites
16. Investment Sites (FOREX, E-Gold Exchange, Second Life/Linden Exchange, Ponzi, MLM/Pyramid Scheme)
17. Sale of any controlled substance without prior proof of appropriate permit(s)
18. Prime Banks Programs
19. Lottery Sites
20. MUDs/RPGs/PBBGs
21. Hateful/Racist/Harassment oriented sites
22. Hacker focused sites/archives/programs
23. Sites promoting illegal activities
24. Forums and/or websites that distribute or link to warez/pirated/illegal content
25. Bank Debentures/Bank Debenture Trading Programs
26. Fraudulent Sites (Including, but not limited to sites listed at aa419.org & escrow-fraud.com)
27. Mailer Pro
28. VPN Services.

We reserve the right to IMMEDIATELY TERMINATE ANY website that is hosting any of the above content WITHOUT notification and WITHOUT any backups provided.

4. The following are examples of unacceptable usage:

1. Attempting to interfere or deny service to any user or host on the Internet.
2. Using the service for mail bombing or spamming
3. Using the service to operate a program that you are not authorized to use
4. Using the service for video encoding
5. Attempting to cancel, supersede, or otherwise interfere with any email other than your own
6. Using the service to engage in syn flood attacks
7. Furnishing false data on your sign-up form, contract, or online application, including providing fraudulent credit card or other payment information

5. Resource Usage:

Users may not:

• Use 10% or more of CPU resources for longer than 60 seconds (Applies to OpenVZ VPS only)
• Use more than 1024MB of Memory/RAM per cPanel Account (Applies to Shared Hosting and Reseller Hosting Services ONLY)
• Use more than 100% of 1 CPU Core PER cPanel Account (Applies to Shared Hosting and Reseller Hosting services ONLY)
• Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD. (Applies to Shared & Reseller Hosting Services)
• Run any bit torrent application, tracker, or client.
• Participate in any file-sharing/peer-to-peer activities
• Run cron entries with intervals of less than 15 minutes

6. Unlimited Disk and Bandwidth Usage Policy:

• Unlimited hosting plans are designed to host most personal, small business and organisation websites.
• Unlimited bandwidth usage is not available for resellers, VPS, and Dedicated servers.
• Unlimited users can not use any music and video files, applications, or zip/rar/iso files.
• Unlimited users can not use it as file storage.
• We do not offer any backup data policy for unlimited hosting packages.

7. IP Number Usage Policy:

As per the regulations of the Bangladesh Telecommunication Regulatory Commission (BTRC), IPTSP-based IP Phone services must be used strictly within Bangladesh through BDIX-connected local internet networks.

Usage of the IP Phone number from outside Bangladesh, through international internet connections, VPS, VPN, or any non-BDIX network is strictly prohibited.

If any violation is detected and proven, the concerned IP number will be permanently deactivated in accordance with BTRC policy.

8. Backup Policy:

We are always committed to keeping our customers’ data secure. However, to prevent unexpected data loss and to maintain transparency regarding responsibilities, our detailed backup policy is provided below:

1. Managed Servers (Shared Hosting, Reseller Hosting, Managed VPS, and Dedicated Servers):
Daily/weekly backups are automatically generated on our managed cPanel servers.

It is the customer’s responsibility to monitor whether their website’s backup is being generated regularly. If the backup process stops due to a software error or a storage issue on the backup server, our support team must be notified immediately. For your convenience, a video tutorial on how to monitor this is provided below:

Warning & Manual Backup: It is a common occurrence for automated backups to temporarily fail or be suspended due to software or system-related issues. Therefore, customers whose daily data is highly sensitive and critical are advised not to rely entirely on the automated backup system. To avoid unexpected incidents, please download a manual backup of your database or website at the end of each workday under your own responsibility.

2. Unmanaged Servers (Unmanaged VPS and Dedicated Servers):
For unmanaged servers, no automatic data backups are Service Renewal, Dues & Backup Retention: maintained by our system.

The responsibility for securing the server’s complete data, files, and databases lies entirely with the customer. To prevent any unexpected data loss, the customer must ensure the necessary backup arrangements (Remote/Local Backup) for their server under their own responsibility.

3. Service Renewal, Dues & Backup Retention:

Backups for managed services are retained for 1 month. Data from expired or canceled services is permanently deleted after 1 month. In such cases, if a backup is required without renewing the service, the entire previous outstanding bill must be paid in full before the backup is provided.

4. IP PBX Call Center:

To maintain server storage and performance, all voice call records from the PBX call center are automatically removed every 1 month.

If any important call records need to be preserved, the customer must download and back them up under their own responsibility before the 1-month period expires.

9. Money Back / Refund Policy:

Hosting services carry a 21-day satisfaction guarantee. To cancel your hosting services and receive a refund, you must contact us within 21 days from the effective date of the particular services you wish to cancel. Only newly purchased hosting fees are refundable. Domain name registration, add fund balance (example: SMS panel, domain reseller, hosting portal, etc.), IP Number, IP PBX, VPS Server, Dedicated Server, Dedicated IP,  SSL Certificate, suspended service due to abuses (example: abuse resource phishing, spamming, etc.), and gateway fees and one-time setup fees are not refundable. If we transfer your site, then the site transfer fee ($5) will be deducted from your refund.

Violations of the Terms of Service will waive any refund.

If your bandwidth usage is more than 5 GB, then the Money Back policy will not be applicable.

RapidLeech hosts 24 hours refund policy applicable.

Any promotional offer/price will not be applicable for a refund.

10. Payment System:

If a shared/reseller account has a past due invoice, we will perform the following actions.

1 Days – No Action Taken

3 Days – Accounts are suspended

21 Days – Accounts will be terminated.

If a VPS has a past due invoice, we will perform the following actions.

0 Days – Dedicated servers will be suspended as soon as an invoice is overdue.

1 Days – No Action Taken

3 Days – Accounts are suspended

7 Days – Accounts are terminated

11. DMCA

All DMCA/Complaints will be forwarded to the account holders to deal with them.

12. Changing terms and conditions

aqait.com has the permission to make any modifications to the terms and conditions at any time, If a customer does not wish to agree on the changes in our terms and conditions, he can cancel the agreement until the date that the new terms and conditions apply, until this date or on the date of receiving of the cancellation, if this applies after the commencing date.
